Terms & Conditions
General
These terms and conditions apply to all agreements between Lekker Creative (“Designer”) and the client (“Client”) regarding design services.
By engaging the Designer, the Client agrees to these terms unless otherwise agreed in writing.
Services
The Designer provides creative design services, including but not limited to graphic design, branding, illustrations, and digital content.
The scope, deliverables, and timelines will be defined in the project proposal or quotation.
Quotations and Agreements
All quotations are valid for 30 days unless otherwise stated.
The project starts once the Client approves the quotation or signs the agreement.
The Designer may adjust fees if the project scope changes.
Fees and Payment
Design services are billed at the agreed rate (hourly or fixed).
Prices exclude 21% VAT, which will be added where applicable.
Payment terms:
Invoices are due within 14 days of receipt unless otherwise agreed.
Late payments may incur interest of 2% per month, calculated from the due date.
For larger projects, the Designer may request an upfront deposit (e.g., 30–50%). Work will not commence until the deposit is received.
Revisions
The quotation includes a defined number of revisions. Additional revisions may be charged at the Designer’s standard rate.
Intellectual Property
The Designer retains copyright on all work until full payment is received.
Upon full payment, the Client is granted a license to use the work as agreed.
The Designer may use work for self-promotion (portfolio, website, social media) unless the Client requests confidentiality.
Client Responsibilities
The Client must provide all necessary information, content, and feedback in a timely manner.
Delays caused by the Client may affect delivery timelines.
Cancellation and Termination
The Client may cancel a project with written notice.
Fees for work completed up to the cancellation date remain payable.
The Designer may terminate the agreement if the Client fails to pay or breaches the terms.
Liability
The Designer is not liable for indirect, incidental, or consequential damages.
Liability for direct damages is limited to the amount invoiced for the project.
Governing Law
These terms are governed by the laws of the Netherlands.
Any disputes will be handled by the competent Dutch court.
Miscellaneous
Changes to these terms must be agreed in writing.
If any provision is invalid, the remaining provisions remain in effect.
